From 12 December 2023, changes to the Sex Discrimination Act 1984 (Cth) will impose on employers, including Local Governments, a positive duty to prevent sexual harassment and sex-based harassment in the workplace. The Australian Human Rights Commission will also be granted new powers to investigate compliance with this positive duty without necessarily receiving a complaint.
