Family and domestic violence leave update

In ER Alert 7 /2022, we advised that the Federal Government would determine whether it will make any amendments to the NES to include a paid family and domestic violence leave (FDVL) entitlement.
Recently, the Federal Government indicated that it would introduce 10 days’ paid FDVL into the NES. The Federal Government is expecting to introduce legislation to this effect early in the sitting period beginning on 26 July 2022. Please click here to see the recent correspondence from the Hon Tony Burke MP, Minister for Employment and Workplace Relations.

As a result, in a recent Statement, the FWC decided to vacate the directions in the FDVL Review requesting parties to formulate a draft model FDVL term and instead will list the matter for mention in early August 2022 to provide parties with an opportunity to express a view as to whether any further steps need to be taken in the FDVL Review.
