Casual Terms Award Review 2021 – Changes to the Local Government Industry Award 2020

In our ER Alert 15/2021 published on 19 July 2021 we advised of the Fair Work Commission (FWC) Casual Terms Award Review 2021.

As anticipated in that ER Alert, on 18 August 2021 the Full Bench of the FWC published a Statement [2021] FWCFB 5123 (Provisional Statement) with its provisional view that the LGIA should be amended to:

  1. Remove the existing definitions of ‘casual employee’ and ‘regular casual’ and replace them with the definitions of those terms contained in sections 12 and 15A of the FW Act, and
  2. Delete the casual conversion clause of the LGIA (clause 11.5) and replace it with a statement that casual conversion is provided for in the NES.

After receiving further submissions on this Provisional Statement, including from WALGA, on 2 September the FWC confirmed the Provisional Statement and that the LGIA would be amended in the manner indicated in it and described above (see FWC Decision [2021] FWCFB 5466).
