Clarification on Incidental Structures & Registered Builders
To assist Members in the implementation of the Building Act 2011 (the Act), an InfoPage on Incidental Structures and Registered Builders has been prepared to clarify this section of the Act.
The following questions were received from Members:
  • whether a patio, carport or shade structure could be considered an “incidental structure”
  • and as such, attract the exemption from the need for a registered builder to do the building work for a patio, carport or shade structure, and
  • if the exemption would apply if the contract value is in excess of $20,000.
An InfoPage has been prepared with the assistance of Local Government Building Surveyors, the Department of Mines, Industry Regulation and Safety, and reviewed by McLeod’s Barristers and Solicitors.
For more information, contact Planning and Improvement Policy Manager, Vanessa Jackson.
