Local Government Industry Award 2020 commencing operation on 29 May

Further to Employee Relations Alert 5/2020, the Full Bench of the Fair Work Commission (FWC) issued a decision on Monday, 27 April finalising the amendments to the Local Government Industry Award 2020 as part of the four yearly review of modern awards.

A copy of the draft determination of the new Local Government Industry Award 2020 containing all recent amendments is available here and commences operation on Friday,  29 May.

The main differences between the Local Government Industry Award 2010 and the Local Government Industry Award 2020 are:
  • the transitional provisions in the Award have been removed
  • a new clause 7 has been inserted to summarise the facilitative provisions in the Award
  • the provision for unpaid family and domestic violence leave has been removed and replaced with a clause stating the leave is provided for in the NES
  • Schedule B is a new schedule containing tables summarising hourly rates of pay for full-time, part-time and casual adult employees, and
  • Schedule C is a new schedule setting out all allowance rates.
Please note there are changes to clause numbering and the order of clauses.

These changes are in addition to the recent amendments to annualised wage arrangements, part-day public holidays and the temporary COVID-19 amendments for unpaid pandemic leave and annual leave at half pay. We are still awaiting a decision from the FWC regarding casuals and overtime.
