Important Update – Local Government Industry Award 2010

The Fair Work Commission has handed down a decision in relation to Family and Domestic Violence Leave ( FDV Leave) as part of the 4 year review of the modern awards.

This decision applies to all modern awards, including the Local Government Industry Award 2010 ( LGIA 2010) and will come into effect on 1 August 2018.

Family and Domestic Violence Leave Entitlement

A new entitlement to 5 days unpaid leave has been introduced for employees dealing with family and domestic violence.

The unpaid FDV leave entitlement will:
  • apply to all employees, including casuals;
  • be available in full at the commencement of each 12 month period rather than accruing progressively during a year of service;
  • not accumulate from year to year; and
  • be available in full to part-time and casual employees, i.e. not pro-rated.

The FDV Leave entitlement will impact Local Governments that apply the LGIA 2010 or those with the LGIA 2010 incorporated into an enterprise agreement. 

For those Local Governments with standalone enterprise agreements, the FDV Leave provision may become relevant during enterprise bargaining, and for the purposes of the better off overall test in the approval process.
