Family Friendly Working Arrangements

As part of the four yearly review of modern awards, the Australian Council of Trade Unions has sought to vary all modern awards to include an enforceable entitlement to part-time work or reduced hours for employees with caring or parenting responsibilities.

The Full Bench of the Fair Work Commission ( FWC) in its September 2018 decision proposed a model term supplementing section 65 of the Fair Work Act 2009 (which forms part of the National Employment Standards) regarding requests for flexible working arrangements.

We have set out the model term here which is proposed to be inserted into all modern awards, including the Local Government Industry Award 2010 ( LGIA).

The Full Bench of the FWC will publish draft determinations in the coming weeks and interested parties will then have 14 days to comment on the draft determinations and confirm whether any award-specific issues are pressed.
