Exposure Draft of the Local Government Industry Award

As part of the four year modern award review, the Fair Work Commission ( FWC ) has released an Exposure Draft of the Local Government Industry Award ( Exposure Draft ) which can be viewed here .

The Exposure Draft contains a number of changes as a result of the plain language redrafting process and does not change the substance of the clauses. As such the proposed changes include altering the order of the clauses in the current Local Government Industry Award 2010 ( LGIA ) and the inclusion of Schedule B – Summary of Hourly Rates of Pay. 

The FWC issued Statement [2019] FWC 932 on 13 February 2019 and Statement [2019] FWC 1262 on 28 February 2019 which called for interested parties to provide comment on the Exposure Draft. The opportunity to provide comment was limited to the plain language redrafting changes only and not any other recent amendments made to the LGIA.

WALGA filed a submission on the Exposure Draft on 5 April 2019 in conjunction with the Local Government Association of the Northern Territory and the Local Government Association of Tasmania which can be viewed here . The submission addresses the plain language redrafting of the higher duties clause in the Exposure Draft and requests a correction to a clause reference.

WALGA and any interested Local Governments will have an opportunity to comment on further revisions to the Exposure Draft in June and September 2019.
